Opposition Threatens Court Action Over IEBC Chair appointment

Opposition leaders led by Kalonzo Musyoka have warned they will challenge the IEBC chairperson’s appointment in court if full consultation is not granted.

They maintained that the appointment of the IEBC chief must strictly follow principles of consultation and concurrence. This will ensure all voices are heard. Furthermore, they are awaiting President William Ruto’s involvement in the final candidate selection before the official gazetting of the chosen name.

The Nelson Makanda-led selection panel is currently conducting interviews for commissioner positions. However, opposition leaders have raised concerns about the integrity and potential conflicts of interest among some of the shortlisted candidates.

During a press briefing, Kalonzo Musyoka, Martha Karua, and Eugene Wamalwa warned that President Ruto might be setting the stage to manipulate the upcoming general elections. This is especially since some individuals with ties to his political allies are being considered for commissioner roles.

“We are looking at this inside out, we are not going to sleep. And if you can recall, a few days ago, I wrote a letter to Raila Odinga. A copy was also issued to President Ruto. This is a matter all of us should be involved in,” Wiper party leader Kalonzo said.

“We are concerned that the Ruto regime is determined to control and direct the recruitment process of the commissioners with the ultimate objective of capturing the electoral management body. We can go as far as saying he is trying to recruit a William Ruto-electoral commission instead of an independent electoral and boundaries commission,” added Martha Karua.

The opposition leaders highlighted specific candidates on the shortlist. They expressed worries about their suitability for the crucial roles within the electoral body. The nomination of the IEBC selection panel had previously faced delays. This is due to a dispute involving Augustus Muli and Koki Muli from the Azimio coalition. Ultimately, the panel was fully formed and its members were sworn in on January 31.

The selection panel comprises Kiome Lindah Gakii, Oloo Adams, James Evans Misati, Nicodemus Kipchirchir Bore, Koki Muli Grignon, Carolene Kituku, Tanui Andrew Kipkoech, Nelson Makanda, and Fatuma Saman. They are tasked with recruiting and nominating individuals for the positions of IEBC Chairperson and commissioners.
