Kitui MCA Cyrus Musyoka Charged with Ksh. 2.2 Million Fraud

Ikanga Itune MCA Cyrus Kisavi Musyoka has been charged at the Kitui Law Courts with eight counts of fraud, including forgery, conspiracy to commit a felony, and obtaining false registration of a motor vehicle.

The court heard that Musyoka allegedly forged vehicle ownership documents and used them to fraudulently secure a loan.

He is also accused of presenting falsified motor vehicle purchase reimbursement documents in an attempt to defraud the Kitui County Assembly of Ksh. 2.2 million.

The charges, brought under the Penal Code, include:

Conspiracy to commit a felony, Forgery of a valuation report, Obtaining registration of a motor vehicle by false pretenses, Uttering false documents, Making a false claim while serving in public office, contrary to Sections 353 and 100 as read with 102A of the Penal Code.

Appearing before Judge L.K. Sindani, Musyoka denied all charges. In his ruling, the judge emphasized that a bond is a constitutional right but comes with responsibilities.

“Bond is a constitutional aspect and the right of the accused to pass. However, the same is enjoyed subject to obligations and responsibilities on the part of the accused to attend court without fail,” he stated.

While no evidence was presented to warrant the denial of bond, the court set stringent conditions.

“In the present situation, I have not been aware of the damage done for me to deny the bond. However, I will deny the bond at Ksh. 500,000 short of the same amount and will try to catch bail with the same amount, Ksh. 500,000,” Judge Sindani ruled.

The case is scheduled for mention on March 6, 2025, for pre-trial proceedings.

In September 2024 the same MCA was beaten by an irate mob in Kamukunji, Nairobi in a suspected theft case.
