High Court stops Nguu/Masumba By-election

The High Court has stopped IEBC from printing Ballot Papers and proceeding with the Nguu/Masumba ward by-elections until the case filed by Timothy Maneno is heard and determined.

Last week, the IEBC dispute resolution committee dismissed a petition by Timothy for the Nguu/ Masumba ward claiming he was unfairly disqualified from the by-elections as an Independent candidate by IEBC.

The disqualification was a result of failure to deliver his clearance letters to IEBC so as to gazette his symbol and was a result of a mix-up at the office of the registrar of political parties according to his lawyers.

Timothy Maneno’s council also asked the court to find that at the time of declaring the Nguu/ Masumba ward vacancy, as per the BBI high court ruling, IEBC lacked a quorum.

The official campaign period started from 25th August to 11th October 2021 from 7 am to 6 pm. The elections were set to take place on the 14th of October 2021.

Eshio Mwaiwa of Wiper Party and Daniel Kivuva Musau of UDA are the only aspirants that had been cleared by IEBC to take part in the by-election.
